1. Acceptance of Terms

By accessing and using SpotMach's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use of Service

SpotMach provides an online platform to connect users with construction equipment rental providers. You agree to use this service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the service.

Specifically, you agree not to:

• Harass or cause distress or inconvenience to any person
• Transmit obscene or offensive content or disrupt the normal flow of dialogue within SpotMach's online communities
• Attempt to gain unauthorized access to our systems
• Use the equipment for illegal activities
• Misrepresent your identity or affiliation

3. Equipment Rental Agreement

Rental Terms:

• All rentals are booked and confirmed via WhatsApp
• Hourly rates are as specified on the website and are subject to change
• Minimum rental period: 1 hour
• Equipment must be returned in the same condition as received
• User is responsible for fuel/battery charges during rental period

4. User Responsibilities

• User must be at least 18 years old and legally capable of entering into contracts
• User must have valid identification and proof of address
• User is solely responsible for the operation and any damage to the equipment
• User must follow all safety guidelines and regulations
• User must possess appropriate licenses/qualifications to operate the equipment

5. Damage and Liability

SpotMach is not liable for any damages caused by the misuse or negligence of the user. Users are responsible for:

• Normal wear and tear exceeding acceptable limits
• Mechanical damage due to improper operation
• Any accidents or injuries during the rental period
• Loss or theft of equipment

6. Payment Terms

• Payment must be made before equipment pickup or delivery
• Accepted payment methods will be confirmed via WhatsApp
• Late returns will be charged at applicable rates
• Cancellations must be made 2 hours before rental time

7. Cancellation Policy

• Free cancellation up to 2 hours before rental start time
• 50% charge for cancellations within 2 hours
• 100% charge for no-shows or cancellations after rental start time

8. Limitation of Liability

SpotMach shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.

9. Modification of Terms

SpotMach reserves the right to modify these terms at any time. Continued use of the service after modifications constitutes your acceptance of the updated terms.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Maharashtra, India, and you irrevocably submit to the exclusive jurisdiction of the courts located in Pune.
